Canada: Changes in trademark law expected in 2019

There are several Canadian trademarks legislative changes upcoming. The exact date was not announced yet, but we expect the new law to come into force in early 2019.

The most important changes are:

  • elimination of the requirement to use the trademark in Canada prior to registration;
  • reduction of the protection period from 15 to 10 years.
  • adoption of Nice Classification;

Additionally, the official trademark fees will significantly increase for multi-class applications. See below the comparison between the new fee structure and the current one.
